Gym IQ Terms Of Service

1. Draft Status And Acceptance

This draft does not itself create a new binding agreement or record your acceptance. After an approved version becomes effective, agreement to that version will be requested through the applicable registration or acceptance process. Any required consumer disclosures and consent must be provided before charging for a subscription.

If you do not agree to an effective version, stop using the affected services. Access to public legal information, support, subscription cancellation and account-deletion controls must not depend on accepting this draft or paying for a subscription.

2. Adults 18 And Older

Gym IQ is intended only for people aged 18 or older who can enter into an agreement under applicable law. Do not use Gym IQ if you are under 18. This intended-audience rule does not represent that age verification has been implemented.

Provide accurate information where it is requested and use the service only where your use is lawful. Contact support if you believe someone under 18 has provided personal information.

3. Personal Fitness Services

Gym IQ provides personal workout building and logging, fitness education, progress records and optional advanced training tools. Available features may include Powerlifting and Bodybuilding planning, media-based AI feedback, private backup, notifications and connected-health readings.

Trainer, Gym and client features have been retired. Gym IQ does not provide an active coaching marketplace, trainer-client relationship, medical service or emergency monitoring service. Historical records from retired features may remain subject to separate privacy, retention and deletion processes.

4. Your Account And Saved Progress

You are responsible for protecting your sign-in credentials and for activity you authorize through your account. Do not impersonate another person, use another person's account without permission or share access to bypass individual subscription or usage limits. Tell support promptly if you suspect unauthorized access.

Guest progress is separate from signed-in account progress. Signing in does not necessarily transfer guest activity, restore every device-local record or copy local photos to another device. Review the app's backup and account controls before changing devices or removing app data.

5. Training Risks And Medical Limitations

Exercise, lifting, diet changes and contest preparation involve risks, including injury. Gym IQ information is general fitness education, not medical advice, diagnosis, treatment, physical therapy or a substitute for qualified professional supervision. Consult an appropriately qualified clinician about medical conditions, symptoms, medications, pregnancy or whether a training activity is suitable for you.

Choose loads and equipment appropriate to your ability, follow equipment instructions and use qualified assistance when needed. Do not treat a generated plan, readiness score, form review, body-photo assessment or missed warning as confirmation that an activity is safe. Stop exercising if you experience concerning pain, dizziness, chest discomfort or other warning symptoms; seek appropriate medical help. For an emergency, contact local emergency services, not Gym IQ.

These explanations do not waive rights or responsibilities that applicable law does not allow to be waived.

6. AI Assistance And Its Limits

AI-assisted machine recognition, selected photo or video reviews, and personalized training recommendations can be incomplete, incorrect or unsuitable for your circumstances. AI cannot reliably determine all injuries, medical conditions, equipment settings, exercise technique or competition outcomes. You must evaluate recommendations and obtain qualified advice where appropriate.

Requesting an AI review may send the selected media or relevant training inputs through Gym IQ's server and its configured AI services, as described in the Privacy Policy and the feature's consent notice. Private backup consent is not AI consent. AI usage is subject to per-account or guest limits and service availability; a paid subscription does not provide unlimited reviews.

Results are informational. Gym IQ does not promise a particular strength increase, appearance change, weight change, injury-prevention outcome or competition placing.

7. Privacy, Health Permissions And Private Photos

The Privacy Policy explains data handling, service providers, local records, optional transfers and deletion limitations. Device permissions, connected-health access, private cloud backup, AI processing and notifications have separate controls. These terms do not replace separately required consent.

Progress photos remain local by default. Choosing private backup does not authorize public sharing or automatic AI analysis. Connected-health features are read-only where supported; missing readings do not establish that permission was denied or that you have no health risk. Withdrawing a permission and deleting previously stored data are different actions.

8. Monthly Subscriptions And Purchases

Gym IQ is free to download. Learning and basic workout logging remain free. The paid full-access product is an auto-renewing monthly subscription for the app's paid digital tools, subject to the available store product and verified entitlement. The purchase sheet displays the actual localized price, billing interval, taxes and applicable store conditions before you confirm a purchase.

Apple App Store or Google Play processes native payments. Gym IQ does not collect payment-card details for those purchases. Purchase verification and restoration may use RevenueCat and Gym IQ's server. Advanced tools and AI reviews remain subject to disclosed usage limits and availability.

Read the separate Subscription Terms and your store's purchase disclosures before buying. A displayed proposed price or a test-store product is not a guarantee that a live purchase is available.

9. Renewal, Cancellation And Refunds

Subscriptions renew automatically unless canceled through the applicable store before renewal. On Apple, turn off auto-renewal at least 24 hours before the current period ends; renewal may be charged within the final 24 hours. Google Play's displayed subscription rules govern its renewal timing. Cancellation normally preserves access until the paid period ends, subject to the store's verified status and applicable law.

Manage or cancel the subscription through the store account used to purchase it. Deleting Gym IQ, signing out, removing a backup or deleting your Gym IQ account does not automatically cancel a store subscription.

Refunds, billing disputes and store-authorized grace periods follow the applicable store rules and mandatory local law. Nothing in this draft removes a refund, cancellation or other consumer right that cannot lawfully be excluded. If verification is delayed, use Retry, Restore or support rather than buying again to resolve the delay.

10. Your Content And Limited Processing Permission

You retain your rights in workout records, photos, videos and other material you provide. You must have the rights and any necessary permission to upload or submit that material, including permission from other identifiable people where required.

For material you deliberately provide to a feature, you grant Gym IQ a limited, non-exclusive permission to store, reproduce, transmit and process it only as needed to provide that requested feature, protect the service and satisfy applicable legal obligations, consistent with the Privacy Policy and your separate consent choices. This is not an assignment of ownership or permission to sell your photos, publish private records or use backup consent as consent to AI analysis.

Permission to process content is limited by its purpose and your applicable withdrawal or deletion choices. Removing content from an active feature does not guarantee immediate removal from device backups, historical evidence or provider-held copies; see the Privacy Policy and the relevant deletion controls.

11. Acceptable Use

Do not use Gym IQ for unlawful activity, fraud, harassment, threats, infringement or uploading content you are not entitled to use. Do not attempt to access another user's records, bypass authentication, defeat purchase verification, evade AI quotas or interfere with service security.

Do not introduce malicious code, overload the service or use unauthorized automated collection or account creation. Do not copy, resell or reverse engineer protected app components except where applicable law permits it or Gym IQ gives permission. These restrictions do not prohibit rights that mandatory law protects.

12. App Content And Third-Party Services

Gym IQ's original software, branding and instructional material belong to its operator or licensors. Your authorized access is for your own personal use, subject to an effective agreement and applicable law. Publicly sourced plans, creator lessons, tutorial videos, music and other third-party materials remain subject to their respective owners' rights and licenses.

External websites, embedded media, music providers, authentication services and app stores have their own terms and privacy practices. Links and educational references do not create a professional relationship with their creators or guarantee that external content remains available. The Apple standard license agreement applies where required by Apple's applicable distribution terms.

13. Availability And Changes To Features

Services can be interrupted by maintenance, network problems, device limitations, verification delays or provider outages. No uninterrupted access, universal device compatibility or error-free AI output is promised. Available readings, features and localized store products can differ by device or region.

Features may be updated or retired. Changes must respect applicable consumer law and existing paid-service obligations. A subscription ending does not itself delete existing workout records. Keep copies of important records where the available controls permit, and do not rely on Gym IQ as your only medical or essential record system.

14. Suspension, Leaving And Account Deletion

Subject to applicable law, Gym IQ may restrict access reasonably necessary to respond to security threats, material misuse, unlawful activity or a breach of an effective agreement. Where lawful and practical, the user should receive a reason and an opportunity to resolve a correctable issue. Contact support to question a restriction or request access to applicable account and privacy controls.

You may stop using Gym IQ and request account deletion through the available account controls or support. Subscription cancellation must still be handled separately through the store. Retention and cleanup of local records, private backup, historical evidence and provider-held information follow their separate processes; this draft does not promise an unverified deletion deadline.

15. Warranties And Proposed Liability Limits

To the extent permitted by applicable law, the service is provided as available without additional promises of fitness for a particular purpose, uninterrupted operation or accuracy beyond any express commitments and mandatory legal obligations. Mandatory consumer guarantees are not excluded.

Subject to qualified legal review and only where lawful, the proposed aggregate limit on Gym IQ's liability for claims arising from the service is the greater of US $100 or the amount you paid for Gym IQ subscriptions in the 12 months before the event giving rise to the claim. To the extent law permits, neither party would be liable to the other for indirect or consequential losses.

These proposed limitations do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability or remedy that cannot lawfully be excluded or limited. They do not waive statutory consumer rights. A qualified attorney must determine which limitations are appropriate and enforceable for the intended markets.

16. Changes To An Effective Agreement

An approved version should identify its effective date and version. Material changes should be communicated with reasonable advance notice where required by law, and any required renewed agreement should be requested before the changes apply. Changes should not be applied retroactively to remove accrued rights.

17. Disputes And Governing Law

For a question or dispute, contact Gym IQ support and describe the issue so it can be investigated. This does not prevent you from using any complaint process or legal remedy available under applicable law.

The operator's country of incorporation and an appropriate governing-law and court-venue provision must be confirmed during legal review. This draft does not select an exclusive jurisdiction, require arbitration or impose a class-action waiver. Mandatory consumer protections that apply where you live remain unaffected.
